The only place you can get a real answer to your question is from your State's Dept of Labor.

I have seen cases where terminal pay is forfeited, held in escrow, required to be paid in cash within 24 hours. It all depends on the job, the employer, and how your state enforces these kinds of things. I have seen many cases where you would have to file a lawsuit (usually small claims) to force payment.

Start with the Dept of Labor, then talk to a local attorney.
